Terms of Service

Version 1.2 — July 28, 2026

1. General

These Terms of Service ("Terms") constitute a legally binding agreement between WishlyBox Ltd ("WishlyBox," "we," "us," or "our") and you ("User," "you," or "your") governing your access to and use of the WishlyBox platform, including the website, mobile applications, and all related services (collectively, the "Services").

By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.

These Terms incorporate by reference the following documents, which form part of your agreement with us:

2. Who Is WishlyBox

WishlyBox Ltd is a platform for creating and managing wish lists, sharing them with friends and family, coordinating gifts through dedicated gift rooms, and tracking important dates and events.

WishlyBox provides a free basic tier of service and generates revenue through paid subscription plans and affiliate links (see Section 10).

3. User Account

Most features of the Services require a registered account. You may register using your email address or through third-party authentication providers (Google or Facebook OAuth).

You must be at least 13 years of age to create an account, or at least 16 years of age if you reside in the European Economic Area (EEA). See Section 5 for details.

Certain features are available without an account, including:

  • Guest wishlists
  • Anonymous gift reservations
  • Quests and games

These Terms apply equally to registered users and guests using any part of the Services.

4. Use of the Services

By using the Services, you agree to the following:

  • You will provide accurate and complete information during registration and keep your account information up to date.
  • You will use the Services for private, non-commercial purposes only (see Section 15).
  • Your login credentials are personal and must not be shared with any third party.
  • You may maintain only one account per person.
  • You will not use the Services for any unlawful purpose or in any manner that could damage, disable, or impair the Services.

WishlyBox reserves the right to suspend or terminate accounts that violate these Terms, and to modify, update, or discontinue any features of the Services at any time.

5. Age of Users

You must be at least 13 years old to use the Services. If you reside in the European Economic Area (EEA), you must be at least 16 years old.

If you are a parent or guardian and believe your child has created an account or provided personal information without your consent, please contact us at support@wishlybox.com to request deletion of the account and associated data.

6. Subscription Plans and Payments

WishlyBox offers the following subscription plans:

All payments are processed through our payment provider, Paddle. By subscribing to a paid plan, you agree to Paddle's terms of service and authorize recurring billing at the applicable rate.

Prices are subject to change. We will provide at least 30 days' prior notice of any price changes. Your continued use of the paid Services after the price change takes effect constitutes your acceptance of the new price.

7. Family Plan

The Family Plan allows up to 6 members to share a single subscription. The account owner ("Family Owner") manages the membership and is responsible for all payments associated with the plan.

Additional family member slots may be added at a cost of $1.99 per slot. All family members receive Premium-level features for the duration of the subscription.

8. Free Trial

WishlyBox offers a 14-day free trial for paid subscription plans. No payment information is required to start a trial.

Users who join through a referral link are eligible for an extended 28-day trial period.

Each account is entitled to one free trial per subscription plan. When the trial period ends, your account will automatically revert to the Free plan unless you subscribe to a paid plan.

9. Cancellation

You may cancel your subscription at any time through the Settings page in the application. Upon cancellation, you will retain access to Premium features until the end of your current billing period.

10. Affiliate Links and Commission

Product links displayed on the Services may contain affiliate tags. When you click on such a link and make a purchase from the retailer, WishlyBox may receive a small commission from the retailer at no additional cost to you.

WishlyBox will never add products to your wishlists or modify your wishlist content. Affiliate tags are applied only to links that you, the user, have added to your wishlists.

11. Links and Third Parties

The Services may contain links to third-party websites, products, or services that are not owned or controlled by WishlyBox. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

Any purchases you make from third-party retailers are solely between you and the respective retailer. WishlyBox is not a party to such transactions.

12. User Content and Intellectual Property

You retain full ownership of all content you create, upload, or share through the Services ("User Content"). By using the Services, you grant WishlyBox a limited, non-exclusive license to store, display, and transmit your User Content solely for the purpose of providing the Services to you.

All intellectual property rights in the Services, including but not limited to software, design, trademarks, and logos, are and remain the exclusive property of WishlyBox Ltd.

Content Integrity: WishlyBox will never add to, modify, inject into, or otherwise alter the content of your wishlists. Your wishlists contain only what you put in them.

13. Gift Reservations

Gift reservations are a coordination tool designed to help friends and family avoid duplicate gifts. A reservation indicates intent to purchase but does not constitute a guarantee of purchase or delivery.

Reservations expire after 14 days by default. The wishlist owner cannot see reservation details (who reserved what) by default; this behavior can be adjusted in the user's settings.

14. Charity Commitment

WishlyBox commits to donating 10% of its revenue to charitable causes. We will publish periodic reports on our website detailing the recipients and amounts of charitable donations.

This commitment is voluntary and may be modified or discontinued at WishlyBox's discretion.

15. Non-Commercial Use

The Services are intended for personal, non-commercial use only. You may not use the Services to promote, advertise, or sell products or services, or for any other commercial purpose without prior written consent from WishlyBox.

16. Liability

The Services are provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied.

WishlyBox is not liable for any goods or services purchased from third-party retailers through links on the platform. Any such transactions are solely between you and the third party.

To the maximum extent permitted by applicable law, WishlyBox's total aggregate liability arising out of or related to these Terms or the Services shall not exceed five hundred US dollars (USD $500) per event giving rise to the claim.

IN NO EVENT SHALL WISHLYBOX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

17. Indemnification

You agree to indemnify, defend, and hold harmless WishlyBox Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, your use of the Services, or your violation of any rights of another party.

18. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, store, and protect your personal data.

19. Changes to These Terms

WishlyBox reserves the right to modify these Terms at any time. Non-material changes are effective when posted. For material changes, we will provide at least 30 days' prior notice via email or in-app notification.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

In the event of any dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitration body.
